House Joint Resolution 36 was introduced this week.
Members of Congress introduced a constitutional amendment that would protect a parent’s right to “direct the upbringing, education, and care of their children.” Representative Debbie Lesko of Arizona submitted the Parental Rights Amendment this week written to establish parenting a child as a “fundamental right.” She said, “Parental rights are under attack across our nation.”
The joint resolution, H.J. Res. 36, would give parents a right to direct the education of their child, which includes the right “to choose, as an alternative to public education, private, religious, or home schools, and the right to make reasonable choices within public schools for one’s child,” and the government cannot “infringe” on that right.
Parental rights advocates say it is high time to stop pitting the state against parents. In 1923, the Supreme Court said, “The child is not the mere creature of the state.” In the 1997 case Washington v. Glucksburg, the Supreme Court said the due process clause of the Fourteenth Amendment protects the fundamental right of parents to direct the care, upbringing, and education of their children.
The amendment would permanently codify the court’s “creature of the state” statement and restore respect for the parent-child bond in America.
